Defendants involved In Min Sang Robbery Convicted

Greenville, MS – In Greenville, Three of the five defendants charged with robbing the Min Sang Grocery Store have been sentenced to serve time in the Mississippi Department of Corrections, District Attorney Dewayne Richardson announced today. Recently in Washington County Circuit Court Elton Harper, Richy Chillis, and Richard Bell were all scheduled to go to trial for the January 2014 armed robbery of Min Sang Grocery where Jerome and Harry Seu were beaten and robbed. Instead of proceeding to trial three of the men charged pled guilty and admitted their roles in this violent robbery and assault.

The main culprits who actually went into the store were Elton Harper and Darius Smith. Harper pled guilty this week to Armed Robbery and Attempted Murder. He was sentenced to a total of 25 years in the custody of the Mississippi Department of Corrections. He will serve the first 20 years of his sentence in prison without the opportunity for early release or parole. Darius Smith was scheduled for a court appearance on last week but it was moved to another week later this summer.

Ricky Chillis pled guilty to Conspiracy to commit Armed Robbery and he was sentenced to 10 years in the custody of the Mississippi Department of Corrections. Chillis will serve the first 5 years of his sentence in prison and then be on probation for the remainder of his sentence. During the plea hearing, Chillis admitted to helping Harper and Smith plan the robbery but he wasn’t present when the robbery and assault occurred. Richard Bell pled guilty to Accessory After the Fact to the above mentioned crimes. Bell admitted his role in hiding the weapons used in the robbery after Harper and Smith fled the scene of the crime. Richard Bell was also sentenced to 10 years in the custody of the Mississippi Department of Corrections. Like Chillis, Bell will serve the first 5 years of his sentence in prison and then be on probation for the remainder of his sentence.

Korderro Robinson is the lone defendant left who is still facing trial for this crime. His case was continued by his attorney last week and he is now scheduled to appear for trial later in this term of court. Richardson added that, “the District Attorney’s office feels that justice has been served by the conviction and penalty imposed on these defendants. This entire community was affected when word spread of Jerome and his brother Harry Seu being robbed and beaten. All defendants sentenced to the Penitentiary for Armed Robbery are required by law to serve 100% of their sentence without any early release or parole.”

Judicial Process

Citizen's Involvement in the criminal justice system typically begins with them being a victim, witness, or defendant of a crime. Arrests are made generally by a judge-issued warrant or by a police officer observing a crime in process. Law enforcement may also arrest someone if it has probable cause to believe the person committed a criminal offense. When individuals are arrested they are routinely advised of their Miranda Rights upon arrest, advising them that they have the right to remain silent and that anything they say will be used against them in court. On being questioned, defendants have the right to have their attorney present or to have one appointed if they are indigent.

Felony defendants appear at a first appearance and have the charges reviewed. A judge will inquire if the defendant has an attorney. If low income, the defendant may qualify for a court-appointed lawyer. No plea is entered at this time unless the defendant wishes to plead guilty or waives indictment and has an attorney present. All felony cases are presented to a grand jury in the county that the crime was committed. In the State of Mississippi, only a grand jury has the authority to indict an individual for a felony offense and require them to stand trial for the charges alleged in an affidavit and indictment.

If an indictment is issued, the defendant is bound over to stand trial or enter a guilty plea to the crimes alleged. When a criminal trial occurs all 12 jurors must find the defendant guilty beyond a reasonable doubt. Sentences are decided by Circuit Court Judges in all criminal matters. In most cases a recommendation is made regarding imprisonment, probation, fines and restitution.
